What is the Summons?

Writer’s note: This blog series is meant to act as responses to “quick” questions you may have for attorneys.  Think of these answers as a “quick” answer you might receive over coffee from your friendly neighborhood attorney.

 

The Summons is one of the initial documents that start a divorce, custody, or child support proceeding.  It is a short document (2-3 pages) that basically says, “Hey, you there! Pay attention! There is a legal proceeding about to start!”

There are a couple of items that are required to be in a Summons: if there is real estate a legal description, temporary restraining provisions (you can’t change insurance, for example), and a parent education requirement.

If you are served a Summons, it is important to talk with an attorney to understand the legal proceeding and your rights.
