Mediation is bringing one or two neutral third parties in to help resolve a dispute. Mediation is a form of Alternative Dispute Resolution, or ADR. ADR is a process that is outside of the courtroom. While it may be court-ordered, the courts are not in control of the ADR process; it is instead the parties who control the process. Claire believes Mediation is an excellent way to resolve disputes cost-effectively.
Studies have shown that parties who come to a mediated agreement are more likely to self-enforce the mediated agreement and not return to court or continue the dispute. Mediation self-empowers the parties to come to their own resolution because parties understand their situation better than any attorney or judge.
